TERMS OF SERVICE

Max Voltage Store - Terms of Service

These Terms of Service ("Terms") apply to your use of the Max Voltage Store website and to any order you place with us, whichever country you order from. By using our site or buying from us you agree to these Terms. Nothing in these Terms limits any consumer rights you have under the laws of your country or state that cannot be excluded.

About us

This site is operated by Max Voltage Store Pty Ltd (ABN 68 689 227 996, ACN 689 227 996), 39 High Street, Kimba SA 5641, Australia. We sell to Australia, New Zealand, the United States, Canada, the United Kingdom and selected European Union countries. You can reach us at support@maxvoltagestore.com, or on 1300 959 544 within Australia.

Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to buy from us.

Currency, prices and taxes

Prices are shown in your local currency for the country you are shopping in: Australian dollars for Australia, New Zealand dollars for New Zealand, US dollars for the United States, Canadian dollars for Canada, pounds sterling for the United Kingdom and euros for the European Union. The price you see at checkout is the price you pay in that currency.

For Australia and New Zealand, prices include GST. For the United Kingdom and the European Union, prices include VAT and import duties. For the United States and Canada, prices include import duties; sales tax or GST/HST, where it applies, is added at checkout. If you choose to ship to a country we do not list, any import duties or taxes charged on arrival are your responsibility.

Products, pricing and availability

We try to keep product descriptions, images and prices accurate, but images are indicative and we may correct errors. Prices may change at any time. Products are subject to availability, and we may limit quantities or decline an order. Not every product is available in every country; the products shown to you are the ones we can supply to your country.

Electrical compatibility

Our mains-output products are sold in the voltage and socket type for the country you are shopping in. Where a product page states that an adapter is needed for your local plug type, that is part of the product description and you are responsible for using a suitable adapter. Our products are designed for use with the battery platforms named on each product page.

Orders and acceptance

Your order is an offer to buy. A contract is formed when we accept and dispatch your order. We may cancel an order and give you a full refund, for example if there has been a pricing error, an item is out of stock, or we suspect fraud or misuse.

Payment

Payment is taken through our payment providers at checkout in the currency shown. By placing an order you confirm that you are authorised to use the payment method. Instalment options such as Afterpay, Clearpay, Zip or Klarna are offered subject to the provider's availability and terms in your country.

Shipping and delivery

Australian and New Zealand orders are dispatched by our fulfilment partner in Sydney, Australia. Orders for the United States, Canada, the United Kingdom and the European Union are dispatched from our international fulfilment centre. Delivery times and costs are set out in our Shipping policy. Risk in the goods passes to you on delivery.

Returns, refunds and warranty

Returns and refunds are handled in line with our Refund policy. Every Volt product is backed by a 2-year warranty and accessories by a 12-month warranty against manufacturing defects in normal use.

Cancellation rights

If you are a consumer in the United Kingdom or the European Union you have the right to cancel an online order within 14 days of receiving it, without giving a reason, under the Consumer Contracts Regulations 2013 or the EU Consumer Rights Directive. To cancel, email support@maxvoltagestore.com within that period and return the goods in line with our Refund policy. Our 30-day change-of-mind returns apply to every country and go beyond this right.

Safe use of our products

Our products convert and supply electrical power. You must use them in line with the supplied product manual and safety instructions, and must not exceed a product's rated specifications. Tools such as our runtime calculator provide estimates only; actual performance depends on your equipment, battery condition and conditions of use.

Intellectual property

All content on this site, including text, graphics, logos, images, product designs and the "Max Voltage", "MVS" and Volt range names, is owned by or licensed to us and is protected by intellectual property laws. You may not copy or reuse it without our written permission.

Third-party brands

Makita, Milwaukee, DeWalt, Ryobi, Ozito, Einhell, Bosch, AEG, HiKOKI, Metabo HPT, Hitachi, Stanley, Craftsman, Black & Decker, Porter-Cable, WORX and other tool-brand names are the trademarks of their respective owners. Our products are designed to be compatible with these battery platforms, but we are independent and are not manufactured by, affiliated with, endorsed by, or sponsored by these companies. Brand names are used only to describe compatibility.

Acceptable use

You agree not to misuse the site, including by attempting to gain unauthorised access, disrupt the site, or use it for any unlawful purpose.

Your consumer rights

Australia: Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded.

New Zealand: Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you are buying for business purposes, you agree that the Consumer Guarantees Act does not apply to the extent permitted by that Act.

Limitation of liability

To the extent permitted by law, and subject to the consumer rights set out above, we are not liable for any indirect or consequential loss. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the goods or paying the cost of resupplying them. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.

Indemnity

You agree to reimburse us for any loss or claim arising from your breach of these Terms or your misuse of our products or site, to the extent permitted by law.

Privacy

We handle your personal information in line with our Privacy policy, including where it is transferred outside your country.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of that country.

We may update these Terms from time to time. The current version will always be on this page, and continued use of the site means you accept the updated Terms.
